How Long Can You Drive a Foreign-Plated Car in Spain? Rules for Residents and Visitors

Every expat forum has the same argument: some say you can drive a foreign car in Spain for six months, others say thirty days, and someone always knows a person who has done it for years. The truth depends entirely on one thing: whether you are a Spanish resident. This guide sets out the actual rules, the fines and the practical route to Spanish plates.

The rule for tourists and non-residents

If your habitual residence is outside Spain, you can drive your foreign-registered car here for up to 6 months in any 12-month period without registering it. The 6 months do not need to be consecutive. The car must be legally registered and roadworthy in its home country, and only you (or another non-resident) may drive it. This is the temporary admission regime, and it covers EU cars as well as UK, Swiss or US cars under the customs rules.

The important nuance is that the 6-month rule attaches to the car and to the person's residence status. A Spanish resident is not allowed to drive a foreign-plated car that belongs to a non-resident friend or family member, except in narrowly defined cases such as an emergency or a car rented abroad for a short period.

The rule for residents: 30 days, in practice 60

Once you become resident in Spain, your car must be registered here. Article 3 of the General Vehicle Regulations gives residents 30 days from the date they establish residence to register any vehicle they own. In practice, the DGT and AEAT allow the registration process to run over the 60-day exemption window if you are applying for the transfer-of-residence relief, and roadside checks are usually lenient if you can show the ITV report or the AEAT filing. But driving a foreign-plated car for months or years while resident is illegal, and the enforcement has tightened significantly since 2023.

What counts as being resident?

  • You are registered on the padron at a Spanish town hall.
  • You hold an EU residence certificate (the green card) or a TIE.
  • You spend more than 183 days a year in Spain, making you tax resident.
  • Your centre of economic interests (job, business, family) is in Spain.

Any one of these can be used by the authorities to argue you are resident. Registering on the padron to get healthcare or school places while telling the Guardia Civil you are a tourist does not work: the officer can check the padron on the spot.

How the Guardia Civil catches foreign-plated residents

Traffic officers look for the tell-tale signs: a foreign car with a Spanish residents' parking permit, a car parked at the same address for months, Spanish supermarket loyalty stickers, children in Spanish school uniforms, and the driver's own statements. In coastal areas with large expat populations (Costa del Sol, Costa Blanca, Mallorca) there are periodic campaigns targeting UK, Dutch, German and Belgian plates. Neighbours also report cars, especially when they take up scarce street parking.

Fines and consequences

  • Driving without Spanish registration as a resident: fine of 500 EUR, and the car can be immobilised until registered.
  • Failure to pay the IEDMT registration tax: AEAT can assess the tax plus a surcharge of 20-50% and late interest, going back four years.
  • For non-EU cars, driving beyond the 6 months without customs clearance is smuggling under customs law: the car can be seized and VAT plus duty demanded.
  • Insurance from the home country often lapses when the car has been abroad for over 90 days or when the policyholder is no longer resident there, so you may also be driving uninsured.
  • A foreign MOT or TUV that expires while the car is in Spain cannot be renewed here, and the home country may cancel the registration.

The practical route: register, sell or export

Once resident, you have three legal options. Register the car in Spain, using the transfer-of-residence exemption if you qualify (owned 6 months, applied within 60 days). Sell it back in the home country, which is often best for old right-hand drive cars or anything with a low value. Or take it out of Spain permanently and buy a Spanish-registered car, which is where importing a better car from Germany or the Netherlands with the full registration handled by an importer often beats the local used market on price.

Registering an EU car typically costs 500-700 EUR in fees (CoC, ITV, DGT, plates, IVTM) plus the IEDMT if not exempt. Importing a UK car adds customs and headlights. Whichever you choose, do it inside the first two months; the exemption is worth thousands and the enforcement risk grows with every month on foreign plates.

Frequently asked questions

I own a holiday home and spend 4 months a year in Spain. Do I need Spanish plates?

No. As a non-resident under 183 days a year you can use your foreign car for up to 6 months in any 12. Keep proof of your residence abroad in the car and make sure your home-country insurance covers extended stays.

Can my Spanish-resident partner drive my foreign car?

Not legally, except for an occasional emergency. Residents may only drive Spanish-registered vehicles, or vehicles they are legitimately using under a short-term rental or a company assignment. This is one of the most common fines in expat areas.

What if I am waiting for my TIE and cannot register yet?

You can start the process with your padron certificate and NIE. The ITV and the AEAT filing do not require the TIE card, only the NIE number and proof of a Spanish address. Do not wait for the card to arrive before starting.
