What Is an Intra-Community Acquisition of a Vehicle?

An intra-community acquisition happens when a professional seller in one EU country sells goods, including a vehicle, to a buyer in another EU country without charging their own domestic VAT — leaving the buyer's country to collect VAT instead. For Spanish car buyers, this is the mechanism behind buying from a German, French or Dutch dealer.

The concept, defined

Under EU VAT rules, when a VAT-registered business in one member state sells goods to a buyer identified in another member state, the sale can be zero-rated at source (the seller doesn't charge their own country's VAT) as long as certain conditions are met — chiefly that the goods physically move from one country to the other. The buyer's country then treats the purchase as an 'intra-community acquisition' and collects its own VAT on it. This is the EU's way of taxing consumption in the country where the goods end up being used, rather than where they were sold, without double taxation along the way.

For a Spanish resident buying a used or new car from a German dealership, this means the German dealer typically won't charge you 19% German VAT on the invoice. Instead, you self-assess Spanish 21% VAT once the car reaches Spain.

Why this only applies to professional sellers

Intra-community acquisition rules are a VAT mechanism, and VAT only exists on sales by businesses or professionals — private individuals don't charge VAT because they aren't VAT-registered traders. So this concept never applies to a private-party sale; a private seller in Germany selling their own used car to a Spanish buyer is outside the VAT system entirely, and that purchase falls under ITP instead, not intra-community VAT.

How the tax actually gets paid

  • You are a private individual: you self-assess Spanish VAT at 21% using modelo 309, filed with AEAT
  • You are a VAT-registered business or professional: the acquisition VAT is reported through your regular modelo 303 return, and if you have deduction rights, it can be VAT-neutral in cash-flow terms

Worked example

A Spanish private buyer purchases a used SUV from a franchised dealer in the Netherlands for 35,000 EUR, invoiced without Dutch VAT under the intra-community regime. Once the car is in Spain, the buyer self-assesses 21% Spanish VAT on modelo 309: 7,350 EUR. Because the seller was a professional dealer, ITP does not apply to this same transaction — VAT has replaced it. IEDMT is calculated and paid separately, on top, based on the car's CO2 bracket.

The golden rule that ties it together

Private seller means ITP, not VAT. Professional dealer means VAT (often via the intra-community mechanism), not ITP. Either way, IEDMT is always due separately on first registration. Intra-community acquisition is simply the specific VAT route that applies when the seller is a business established in another EU country.

Does the German dealer's invoice show 0% VAT?

Typically yes, when the sale qualifies as intra-community and both parties provide valid VAT identification. The invoice usually references the exemption explicitly rather than simply omitting VAT, and it is this invoice you present when self-assessing Spanish VAT afterward.

What if the dealer mistakenly charges their domestic VAT anyway?

This does happen, particularly with used cars under a dealer's margin scheme rather than standard VAT. It changes the mechanics of what you owe in Spain, so it is worth confirming with the seller upfront which VAT regime applies to your specific purchase before agreeing a price.
